Empadronamiento in Spain. What is registration, when is it mandatory, and how do I get it?

Are you buying property in Spain, planning a move, or planning to spend most of the year here? Sooner or later, you're likely to encounter the concept of empadronamiento. It's one of the basic formalities associated with settling in Spain, though it's still subject to considerable confusion.

Are you buying property in Spain, planning a move, or planning to spend most of the year here? Sooner or later, you're likely to encounter the concept of empadronamiento. It's one of the basic formalities associated with settling in Spain, though it's still subject to considerable confusion.

Is registration mandatory? Do you need an NIE number? Should the owner of a holiday apartment also register? And does empadronamiento automatically grant Spanish residency?

We explain how it works in practice and what to pay attention to.

What is empadronamiento in Spain?

An empadronamiento is an entry in the municipal register of residents, or Padrón Municipal de Habitantes. It is maintained by the local city or municipality office, called the Ayuntamiento.

The register serves to record individuals who actually reside within a given municipality. It contains, among other things, personal data and the address of their usual place of residence.

Under Article 15 of Spanish Law 7/1985, every person residing in Spain is required to be registered with the municipality where they normally live. This provision applies to both Spanish citizens and foreigners.

If someone lives alternately in several Spanish municipalities, they should be registered in the one where they reside for the largest part of the year.

It is worth remembering that empadronamiento confirms the actual place of residence, not ownership of the property.

This means you can own an apartment on the Costa Blanca and not have to check in at its address if you are only there for a holiday.

Why is empadronamiento needed?

Although the registration itself does not grant additional residence rights, it is an important document in many administrative matters.

Confirmation of residence

A certificate of empadronamiento may be required when completing formalities that require proof of residence in a specific municipality.

Access to healthcare

Data regarding your place of residence may be required during procedures related to registration with the local healthcare system.

However, it's important to remember that registration alone doesn't automatically entitle you to free public healthcare. Eligibility depends on your individual situation and applicable insurance policies and access to services.

Enrolling your child in school

Home address is important for admission to many Spanish educational institutions. If there are more applicants than available places, proximity to the school may be one of the criteria for awarding points.

Detailed rules are defined by individual autonomous communities.

Official matters and local services

A document confirming residence may also be needed in procedures related to municipal services, specific benefits or other formalities in which the actual place of residence is important.

This does not mean, however, that every benefit or service is automatically available solely on the basis of registration.

Empadronamiento a NIE and Spanish residency. What's the difference?

These are three different issues that are often confused with each other.

The NIE (Número de Identidad de Extranjero) is a foreign national identification number used in Spanish administrative and legal procedures. It may be needed, among other things, when purchasing real estate.

An empadronamiento is an entry in the register of residents of a specific municipality. It confirms one's actual place of residence.

The Certificado de Registro de Ciudadano de la Unión is a document confirming the registration of a European Union citizen in the Spanish Central Register of Foreigners.

Polish citizens who intend to stay in Spain for a period longer than three months are obliged to submit an application for registration of residence as an EU citizen within three months of arrival.

This procedure is separate from empadronamiento and comes with its own requirements.

It is also worth remembering that having an NIE number does not automatically mean you have the right to stay in Spain.

Does empadronamiento mean tax residence in Spain?

No. And this is one of the most important issues, especially for property owners who live in Poland.

Entry in the register of residents alone does not constitute a guarantee of obtaining Spanish tax residency.

Under Spanish tax law, an individual may be considered a tax resident, among other things, if he or she stays in Spain for more than 183 days in a calendar year, taking into account specific rules for calculating residence.

The second important criterion is the location of the main centre or base of business or economic interests.

Family circumstances may also be important, and in international situations, an appropriate double taxation treaty.

Therefore, registration should not be equated with the automatic obligation to settle all income in Spain.

At the same time, the lack of empadronamiento does not exclude the recognition of a person as a tax resident if he or she meets the relevant conditions.

How to arrange empadronamiento step by step?

The formalities are carried out at the office responsible for the actual place of residence.

Depending on the municipality, this can be done in person or electronically.

Step 1. Check the procedure with your Ayuntamiento

On the office website, look for the Padrón Municipal, Empadronamiento or Alta en el Padrón tab.

Check whether a prior appointment, i.e. cita previa, is required and what documents must be presented.

Not all municipalities apply identical organizational principles.

Step 2. Prepare your ID document

A Polish citizen may use a valid identity card or passport.

If you already have an EU citizen registration document with a NIE number, the office may also require you to provide this number.

Spanish regulations allow the identification of an EU citizen on the basis of an identity card or passport when he or she does not yet have the appropriate registration document.

However, it is worth checking local requirements and how they are applied.

Step 3. Prepare your address proof document

Depending on the situation, this may be a property deed (escritura), a current extract from the property register (nota simple), a current lease agreement with documents confirming its execution, or an appropriate authorisation if you live with someone else.

Some offices also accept other documents relating to the indicated address, such as utility bills.

The office can check whether you actually live at the address provided.

Importantly, ownership or lease documents primarily serve to confirm actual residence. Registration alone does not determine who owns the property.

Step 4. Submit an application

Complete the registration form, often referred to as the hoja padronal, and attach the required documents.

If you are also registering children, the office may require documents confirming kinship and parental consent or appropriate declarations and documents regarding parental authority.

Step 5. Get confirmation

After registration, you can apply for a document confirming your registration.

In some municipalities you will receive it electronically, while in others you may have to collect it in person.

If the documents are complete and unquestionable, the entry can be made without further processing. If data verification is necessary, the process may take longer.

Certificado de empadronamiento or volante de empadronamiento?

In Spain you will find two types of documents confirming registration details.

Certificado de empadronamiento is an official certificate that formally confirms the data contained in the register of residents.

The empadronamiento (Volante de empadronamiento) is for informational purposes only. It is sufficient for many everyday matters, but it does not replace a certificate where the office specifically requires one.

There is no single nationwide rule that states that any such document automatically expires after three months.

The institution receiving the document may, however, require a certificate issued no earlier than a specified date.

Therefore, before submitting your application, it is worth checking which document you need.

How much does empadronamiento cost and how long does it take?

The cost and organization of the procedure depend on the specific office.

In Alicante, for example, access to the municipal register of residents is free of charge. It is also possible to submit applications electronically if the applicant has the appropriate electronic identification tools.

In other municipalities, please check the current procedure and any fees for issuing specific documents.

There is also no single waiting period applicable to all offices.

If additional data verification is necessary, the procedure may take longer. Generally, regulations provide for a three-month administrative deadline for processing an application for registration.

Can I check in to a rented apartment?

Yes. You don't have to be a property owner to get empadronamiento.

The most important thing is to actually reside at the given address.

If you are renting an apartment permanently, the basis for address confirmation will usually be the current lease agreement and documents indicated by the office.

If you live with another person, you may need appropriate authorization.

It is worth knowing that the office should not treat registration as a procedure for resolving disputes about ownership or lease rights.

The register is intended to reflect the actual state of residence.

Does the owner of a holiday apartment have to register?

Not just because of the fact of owning real estate.

Let's imagine someone who lives and works permanently in Poland and owns an apartment in Torrevieja, Spain, which they use for vacations and a few short trips a year.

In such a situation, the purchase of an apartment does not automatically mean the necessity of making an empadronamiento.

The situation is different if the owner actually moves his or her habitual residence to Spain. In that case, he or she must be registered with the relevant municipality.

Registration is also not a condition for purchasing real estate in Spain.

Does the empadronamiento need to be renewed?

Not everyone needs to renew their entry periodically.

According to Spanish regulations, the obligation to renew the entry every two years applies to a specific group of foreigners from outside the European Union who do not have a long-term residence permit or are not covered by the exceptions indicated in the regulations.

Polish citizens do not have a general obligation to renew their empadronamiento every two years.

However, the office may carry out checks to ensure that the data is up to date and verify whether a given person still actually lives in the commune.

If you change your residential address, you must update your details in the register.

When moving to another Spanish municipality, it is generally sufficient to register in the new location. Your previous registration will be deleted as part of an administrative procedure.

The most common mistakes regarding empadronamiento

I bought an apartment, so I have to check in

No. The mere purchase of real estate does not constitute such an obligation. The actual place of residence is decisive.

I have NIE, so I am already registered

No. The NIE number and registration with the Padrón Municipal are separate issues.

Registration means that I am automatically a Spanish resident

No. Empadronamiento does not replace the formalities related to legal residence, nor does it determine tax residency on its own.

I don't own the apartment, so I can't check in

False. A person renting an apartment or living at a specific address on some other basis can also obtain a residence registration.

Without registration, you cannot buy a property in Spain

False. Empadronamiento is not a general requirement for concluding a real estate purchase transaction.

Empadronamiento in Spain. Summary

The Empadronamiento is a basic document for people actually living in Spain. It confirms residency and is useful during many administrative procedures.

However, it should not be confused with the NIE number, the residence registration of a European Union citizen or tax residence.

If you are planning to buy a property on the Costa Blanca, Costa Cálida, Costa del Sol or Costa de Almería, it is worth determining from the outset how you intend to use it.

Different issues will be important for someone buying an apartment solely for vacation, different for an investor, and still different for a family planning a permanent move.
